Sony Confirms AT&T Mobility Ruling Spurred New PSN TOS Change 800°
180w ago - Last week we reported that the PSN Terms were updated followed by how to Opt-Out of the new Class Action waiver, and today Sony confirms to CNN (linked above) that the AT&T Mobility v. Concepcion (PDF) US Supreme Court ruling earlier this year spurred the recent PlayStation Network TOS change.

To quote: "Sony said this week that the new terms-of-service changes were made, as some analysts suspected, in response to a Supreme Court decision in April. In that case, AT&T Mobility was permitted to include and enforce a clause in employment contracts that bars workers from bringing class-action suits.

"The Supreme Court recently ruled in the AT&T case that language like this is enforceable," a spokeswoman for Sony's PlayStation unit wrote in an e-mail.

"The updated language in the TOS is designed to benefit both the consumer and the company by ensuring that there is adequate time and procedures to resolve disputes."

181w ago - Yesterday we reported on Sony's updated Terms of Service which included a clause to waive participating in new class action lawsuits against the corporation, and today VideoGameWriters.com notes how to opt-out of the new PSN TOS class action waiver while still being able to access PlayStation Network.

To quote: "However, as user ThinkWeak on Slashdot pointed out, there is a remedy written into the ToS for consumers who do not want to roll over for Sony.

On page 17 of the full Terms of Service, (section 15 paragraph 3), there is the following helpful information, capitalized to indicate that they are yelling at you for some reason:

RIGHT TO OPT OUT OF BINDING ARBITRATION AND CLASS ACTION WAIVER WITHIN 30 DAYS. IF YOU DO NOT WISH TO BE BOUND BY THE BINDING ARBITRATION AND CLASS ACTION WAIVER IN THIS SECTION 15, YOU MUST NOTIFY SNEI IN WRITING...

181w ago - It's been only five weeks since the last PSN TOS update, and today I received an e-mail from Sony updating their new Terms of Service and Privacy Policy once again, which also introduces Sony Entertainment Network as outlined below.

According to the new Terms of Service Agreement (PDF File), those who continue to use PSN must essentially waive all rights to participate in new class action lawsuits against Sony and agree to resolve such matters on an individual basis only.

To quote: On September 15, 2011, Sony Network Entertainment America Inc. ("SNEA") will transfer its online services operations, including your wallet and the funds in it, to Sony Network Entertainment International LLC ("SNEI").

The first time you sign in to your PlayStation Network account on or after September 15, 2011, you will be asked to enter into a new Terms of Service and User Agreement ("TOS") and Privacy Policy with SNEI if you wish to continue using your PlayStation Network account. 206w ago - SCEA has created a division dubbed Sony Network Entertainment America (SNEA) and as of April 1, 2011 (no April Fool's joke) PSN users will be prompted to agree with their new Terms of Service (TOS).

To quote from Examiner.com: "Starting on April 1st, SCEA will transfer their online service operations to Sony Network of America.

In this transaction, Sony will be transfering your PSN wallet information and funds to SNEA for handling. On or after April 1st, PSN users will have to agree to the new terms.

Those that decline the new terms may be declined service and PSN account will be closed.

211w ago - I just logged into PSN via my laptop to remove my credit card info after reading the last article PS3 Hackers Address Potential PSN Security Issues and Bans and the first thing it made me do was re-accept the revised PSN Terms of Service & User Agreement Version 8 from February 16, 2011 similar to a few months back when it last changed.

Below is a V7 to V8 PSN TOS comparison for those curious:
