November 17, 2010 // 8:25 am - Update: As confirmed by many users now (including DJLO who posted the pictures below), along with stopping PSN gamesharing Sony has blocked PlayStation Network access for PS3 Debug (8002A212 Error) and PS3 JailBreak users who now are asked to update their console through a message prompt.

Just over a month ago PS3 JailBreak users had a PSN ban wave scare, and today a new PAN/Europe TOS update may indicate that Sony is finally planning to begin banning JailBroken PS3 consoles on PlayStation Network.

Currently Sony's User Agreement and Terms Of Service are last updated as of June 29 of this year, however, several users are reporting that they are now required to agree to the updated TOS when taking their PS3 consoles online.

While it may not be due to the recently released PSN Tool or PSIDPatch, here are the rumored changes from freeforall9 on PSX-Scene (linked above) as follows:

• You must not use any unauthorised hardware or software to access or use Sony Online Services or make, or distribute unauthorised software or hardware via, or in connection with, Sony Online Services (including but not limited to cheat code software or devices that circumvent any security features or limitations included on any software or devices).
• You must not modify or attempt to modify the online client, disc, save file, server, client-server communication, or other part of any Service or cause disruption to any account, system, hardware, software, or network connected to Sony Online Services for any reason, including to gain an unfair advantage in any Service.
• You must not bypass or attempt to bypass any user authentication systems or security feature or attempt to hack or reverse engineer any code or equipment in connection with Sony Online Services (unless permitted by applicable law).

If one changes their PSID now, gets banned and returns to the original PSID could this problem be overturned.

Fact #1: This is just an TOS update for PAN / EUROPE owners (UK, Africa, Aussie, Europe)!
Fact #2: This brings the PAN / EUROPE agreement to the same level we had in NA (America) since June!
Fact #3: PSN is going down in those countries for service update, so you will see error 8002A240!

There will be PSN maintenance occurring between 16:05 and 23:00 on Thursday 18th November 2010. During this time, PlayStation Store (via PC and PS3) will be unavailable together with Account Management and Registration services. Users already signed in should not be affected and those that have signed in previously may still be able to do so on their PlayStation 3.

We apologise for any inconvenience this outage may cause.

Ok I understand what you are saying. I'm not concerned as I have 2 ps3's. I was just wondering if anyone else had this happen in the last couple of days. It happened before when this thread started as well, which seemed to be wide spread.

Yea, that is just a misinterpretation though... it will download automatically but not install without your actual approval/consent.

It was worded like they will not even ask you to agree to anything. It said "without prior notice" which to me would seem to suggest a stealth security update.

Correct, but they won't automatically install as it will still prompt you to agree to the terms... of course if you decline then you won't be able to access PSN at the moment.

I know that you can turn off automatic updates but these tos seem to read that is dosen't matter if you do, updates will still be installed if you log into psn.

When I tried to log into psn today, it said that I had to agree to the tos again. I scrolled down and found a line in it that said that as soon as i'm logged into psn, updates can be installed without prior notice. Has anyone else had this happen to them recently. I'm from the U.K. by the way.

Today Sony goes for sensation - all Debug consoles owners have been restricted to PSN.

Until today we could easily access PSN via any Debug firmware, started from v2.0 and higher. And today, trying to access PSN on Debug firmware, I got a message.

Attempting to do the same on older firmwares I got the same 8002A212 Error.

So, from now we can only access PSN (both Debug and Retail) on 3.50 FW.

Update: From the latest TOS change: Unless expressly authorised by us, you must not:

  • share, sell, transfer, rent, or sublicense any Service or part of any Service to anyone else; or
  • modify, adapt, translate, reverse engineer, decompile, or dissassemble any Service or part of any Service (unless permitted by applicable law); or
  • create any derivative works, attempt to create the source code from the object code, or download a Service or any part of a Service for any pupose not authorised by us; or
  • copy, reproduce, communicate to the public or transit, use for public performance or exploit any Service or part of any Service

that sucks, didnt get a chance to play online with my jb ps3, been playing the legit ps3 on cod non stop.

i can't go online with any psgroove version anymore whilst on a legit ps3 on 3.50 psn just works fine getting a message on the jailbreaked one that i have to update my console...
