April 22, 2010 // 2:04 am - With the PS3 Firmware 3.30 update, Sony has introduced a new Terms Of Service and User Agreement - Version 6.0 (April 21, 2010).

The most interesting is paragraph 11, to cite:


From time to time, it may become necessary for SCEA to provide certain content to you to ensure that Sony Online Services and content offered through Sony Online Services, your PlayStation 3 computer entertainment system, the PSP (PlayStation Portable) system or other SCEA-authorized hardware is functioning properly in accordance with SCEA guidelines.

Some content may be provided automatically without notice when you sign in. Such content may include automatic updates or upgrades which may change your current operating system, cause a loss of data or content or cause a loss of functionalities or utilities.

Such upgrades or updates may be provided for system software for your PlayStation 3 computer entertainment system, the PSP (PlayStation Portable) system, or other SCEA-authorized hardware. Access or use to any system software is subject to terms and conditions of a separate end user license agreement found at

You authorize SCEA to provide such content and agree that SCEA shall not be liable for any damages, loss of data or loss of functionalities arising from provision of such content or maintenance services. It is recommended that you regularly back up any archivable data located on the hard disk.

Is it just me, or is Sony trying to cover their bottoms?

i have just about had it with sony. i sold the 360 and bought the damn thing because i felt it was better. but now, 40% of my content is now worthless... my penny jar with $1.47 is worth more than these games right now.

I am proposing a class action lawsuit, because I just cant stand the corporate bullying that is going on. I mean, changing the firmware that removed the OtherOS was within their right (although i sure as heck don't agree with it), but then to render EVERY game that was downloaded (and PAID FOR) via the PSN useless, as well as games like Warhawk and MAG is just criminal.

What they have done is the same as me punching someone in the face, then having the person sign a waiver stating that 'i am not responsible for the first punch, and by signing this, you will not be punched again.' I can say whatever I want, but at the end of the day, its still illegal and I will be held accountable in a court of law.

We, as consumers, need to step up and say 'Enough is enough' collectively, as one voice. As long as people keep complaining to Customer Service, they will keep brushing us aside. But if there is a class action lawsuit, they can't brush us aside and our voices will be heard.

This also means that in future updates of all kinds including firmware will be installed without asking you.

You can't opt out if your not asked. I'm still on pre 3.21 so I've not accepted any of the new terms and neither do I intend to.

If I don't access their services or sign-in then I'm still under my old terms which do not state they can push updates whenever they want without asking and also do not state they can remove features.

well in this case, i think they just screwed themselves over.. how can they cover themselves AFTER theyve done something wrong? this revision was released after the fact.. so they just pretty much agree that they were wrong.

i still dont see why anyone hasn't brought up that since 3.21 was an option, then sony is telling me i cant play my online only games even after i've paid for them, or the rights to play them or whatever.. if i decided not to upgrade to 3.21. thats kind of like selling you broken games.. "pay me, but they wont work" so in a way, they do force you to upgrade.

These guys don't care about losing consumers at all it seems. They figure you are addicted to the playstation network. It's really damn strange; I wouldn't expect them to get THIS paranoid.

Well those terms are illegal according to european law, especially the option about automatically update WITH cause of data loss..

Here is the email I received from PlayStation(R)Network on the subject. Maybe we should all terminate at the same time?

Please visit to review the new terms and policy. The revised Terms of Service and User Agreement and Privacy Policy apply to PlayStation(R)Network account holders and their Sub Accounts. The revised Privacy Policy also applies to any visitors to SCEA websites.

If you do not agree with the new Terms of Service and User Agreement or Privacy Policy, please contact Customer Service to terminate your PlayStation(R)Network account(s) and do not visit PlayStation(R)Network or our websites. Continued use of your PlayStation(R)Network accounts by you or your associated Sub Accounts means that you agree to the new Terms of Service and User Agreement and Privacy Policy. Continued use of any SCEA website means you agree to the new Privacy Policy.

I wish to know what data or content or functionalities or utilities are needed to be deleted. I want to download and use it on my 3.15.
