April 22, 2010 // 4:04 am - With the PS3 Firmware 3.30 update, Sony has introduced a new Terms Of Service and User Agreement - Version 6.0 (April 21, 2010).

The most interesting is paragraph 11, to cite:

11. MAINTENANCE AND UPGRADES

From time to time, it may become necessary for SCEA to provide certain content to you to ensure that Sony Online Services and content offered through Sony Online Services, your PlayStation 3 computer entertainment system, the PSP (PlayStation Portable) system or other SCEA-authorized hardware is functioning properly in accordance with SCEA guidelines.

Some content may be provided automatically without notice when you sign in. Such content may include automatic updates or upgrades which may change your current operating system, cause a loss of data or content or cause a loss of functionalities or utilities.

Such upgrades or updates may be provided for system software for your PlayStation 3 computer entertainment system, the PSP (PlayStation Portable) system, or other SCEA-authorized hardware. Access or use to any system software is subject to terms and conditions of a separate end user license agreement found at http://www.us.playstation.com/termsofuse.

You authorize SCEA to provide such content and agree that SCEA shall not be liable for any damages, loss of data or loss of functionalities arising from provision of such content or maintenance services. It is recommended that you regularly back up any archivable data located on the hard disk.

Is it just me, or is Sony trying to cover their bottoms?

I definitely smell a law suite, silent updating with possible loss of data... and we are supposed to back up our data... If I remember correctly you can't backup all data so you might still loose some.

And according to law there's a limit on what you can legally expect users to do. Backup with lots of games on the disks takes for hours...

but you know the risk, if you don't update your software then you wont be allowed access to psn... come on we have known this for some time, thats the way the system was originally designed it will ask you if you want to update then if you refuse you get cut off from psn till you do update. we have known this and accepted this for a long time its just the way it is.

now if you are angry about it do something about it do some research learn what you need to try and crack the ps3... and why are people today so online addicted? how did i ever survive my childhood playing nintendo, playstation and sega single player game and 2 player splitscreen? why are all these things dead in gaming today?

Because online gaming has taken over peoples minds its like thats the only thing most people who play games cares about any more. I remember a time when you played games for fun or for an engaging story, not to earn trophies or achievements or or play online with people you didnt know. no it was for fun you got you and 4 of your greatest buddies together to see who was top dawg against the hardest AI, it was playing through a story and at the end feeling like you were satisfied like you accomplished something.

i don't know maybe the days from when i was a kid are gone and we are forced to live in a crazy world of streaming background updates and random hardware sweeps... they are pushing us and we have to show them that we arnt going to take it we are not going to lay down and let them turn off features on our system that we bought just so that they can feel secure that a little bit of money off the top will be protected.

Dear Disgruntled Customer;

The Playstation 3 firmware update version 3.30 as been performing exactly as we have planned. Your misery brings us great joy here at Sony and we look forward to the next step of "Accident Testicular Removal". Once the firmware has completed removal please stand by while a member of the Sony Computer Entertainment Customer Service Team comes to collect your tears. As you know your tears are vital to the life of our executives and we thank you with your unvolunteer donation.

Sincerely; Sony Computer Entertainment Management Sustenance Board Director.

I was wondering what is everyone doing now with their ps3. I updated to 3.21 because i wanted to play online with my bought games, but now since SONY has made another frame-ware update that has hidden features that makes it possible for SONY to spy on a person and make sure everything on their hard drive isn't pirated and Legal. What the heck has happen to this world seriously.

I am posting this hopping someone has answer for me like a Bypass maybe? I thought Sony went to far with the 3.21 update, but now the next update is just madness. As a paying Sony Customer i have to say i am not going to agree with their terms of service this time.

Who else feels the same way and has the answer i suppose everyone is looking for now to play online? -- It would be nice to play online without Big brother spying on everything you do!

Let me know what if anyone has any suggestions for me thank you.

Even though I am upset with the way $ony is protecting their intelligence, they are within their rights to do so. This will never entitle them to enter into any private media. Their purpose is purely to protect/safeguard their own intelligence built into the PS3. If they do however access your private data on any device or media centre, then you CAN sue them. This infringes on any country's right to privacy acts. This alteration does not give them carte blanche to do whatever they want with your systems. Frankly, I don't think they give a rats #$@%^ about your illigal downloaded movies (except perhaps the ones made in their own studios). Perhaps they will enjoy watching your home porn movies just as much as you ... who knows ...

I am also stunned at the amazement shown by all on this forum with the actions taken by $ony - what did you expect when EgoSnot made it public that he hacked the PS3. Everyone was excited (except $ony) that now homebrew can be made and run on their ($ony's) own operating system. Something we have to accept is that you can't have the best of both worlds. Make a decision - 1. Stick with OFW and abide by $ony rules - go onto PSN, ply online, no banning etc. or 2. Wait for CFW (when/if that will surface) and bear the consequences of any action for doing so - but you get to keep linux and perhaps (by a long shot) get some things you asked $ony for on your system in 12 months' time.

I must make this clear .... $ONY DOES NOT CARE FOR YOUR SPECIFIC SITUATION!!! They are protecting their own interest. If they did care so much about you the "loyal supporter" (like wonderbra), they would have included those requests in previous FW updates - you know - all the nice things people asked them for like cross game chat, b/c etc etc etc.

I am also sad... don't get me wrong...

Ok it is me being paranoid or not? As I read this "If you do not agree with the new Terms of Service and User Agreement or Privacy Policy, please contact Customer Service to terminate your PlayStation(R)Network account(s) and do not visit PlayStation(R)Network or our websites. Continued use of your PlayStation(R)Network accounts by you or your associated Sub Accounts means that you agree to the new Terms of Service and User Agreement and Privacy Policy. Continued use of any SCEA website means you agree to the new Privacy Policy."

If I do not terminate my PSN account, I may automagically get updated from 3.15 to whatever? I use the PS3 to stream captured MPG movies from my STB via firewire (1394) from a PC media server so it is on the network a lot. I don't need no stinking Blu-ray !
